These Terms & Conditions apply to all orders placed with Simply Arena Mirrors Ltd (“the Company”, “we”, “us”, “our”). By placing an order, you agree to be bound by these Terms.

1. Definitions
Customer means the person, company or organisation purchasing Goods from the Company.
Goods means arena mirrors and associated products supplied by the Company.
Contract means the agreement between the Customer and the Company for the sale of Goods.

The Company reserves the right to amend these Terms from time to time. The applicable version will be that in force at the date of order.

2. Quotations, Orders, Acceptance & Cancellation
2.1 Our quotations are normally valid for 30 days, however if material prices are fluctuating significantly when the quotation is produced, this may be reduced and will be shown as appropriate on the quotation.

2.2 Orders can be placed verbally, in writing or on-line and are subject to acceptance by the Company.
2.3 An order is confirmed once an order acknowledgement has been received by the Customer and (at least) a deposit payment has been received by the Company.
2.4 It is the Customer’s responsibility to ensure that the length / area of reflection they wish to cover is measured accurately to confirm that the products ordered will fit in the planned space.
2.5 The Company reserves the right to refuse or cancel any order at its discretion.

2.6 Cancellation of an order by the Customer should be made in writing; the deposit is non-refundable.

3. Pricing & Payment
3.1 All prices are quoted in GBP (£) and are subject to VAT where applicable.
3.2 A deposit of a minimum of 50% is required at the time of order by on-line payment or bank transfer:

3.3 Full payment must be received as cleared funds before12 noon on the day prior to the agreed delivery date unless otherwise agreed in writing.
3.4 The Company reserves the right to delay manufacture or delivery where payment terms are not met.

4. Manufacture & Lead Times
4.1 All Goods are manufactured to order, however we normally hold a limited buffer stock which can be available for collection from our premises.
4.2 Lead times provided at the time of quotation or acknowledgement are estimates only and are not guaranteed.
4.3 The Company shall not be liable for delays caused by circumstances beyond its reasonable control, including material shortages, supplier delays, transport disruption, or extreme weather and/or unsafe site conditions (including icy, flooded or unstable ground).

4.4 The Company will notify the Customer as soon as reasonably practicable of any anticipated delay.
​
5. Delivery & Collection
5.1 The Company delivers nationwide using its own dedicated transport.
​
5.2 The delivery charge will be itemised on the quotation or on the web-site as appropriate.
5.2 Delivery dates and approximate time of delivery will be agreed with the Customer at the earliest opportunity.
5.3 The Customer must ensure safe, suitable and level access for delivery vehicles and make provision for a clear temporary storage location close to the delivery vehicle.

5.4 The Company will off-load the arena mirrors and associated products and place them in the temporary storage location.
​
5.5 Collection of Goods from our premises is by prior arrangement.
​
5.6 Risk in the Goods passes to the Customer upon delivery / collection.
The Company shall not be liable for damage arising from inadequate access, unsafe site conditions, or improper unloading / storage arrangements.

6. Installation Guidance
6.1 The Company supplies Goods on a supply-only basis and does not provide installation services.
​
6.2 When the Customer purchases arena mirrors only, they should always be mounted onto a strong, sturdy, straight structure and be well supported to ensure a good reflection.
​
6.3 The Company will provide installation guides where appropriate and are personally available on the telephone to provide help, advice and support whilst the installation is taking place.
​
6.4 Contact details of independent installation contractors may be provided upon request; however, the Company accepts no responsibility for their workmanship.
​
6.5 If the Customer is employing a third party to install the arena mirrors, the third party must adhere to the installation guidance provided and should contact the Company prior to installation if they have any questions.
6.6 The Company will not be held liable for any additional costs incurred by the Contractor.

6.7 The Company will not be held liable for any additional costs incurred due to the installation guidance not being adhered to.
​
7. Inspection, Returns & Refunds
7.1 The Customer must inspect the Goods immediately upon delivery.
7.2 Any damage must be reported immediately to the delivery team.
​
7.3 All Goods supplied are non-returnable and non-refundable unless faulty.
7.4 Where a refund is approved, it will be processed via the original payment method.
​
8. Warranty
8.1 The Company warrants that the Goods will be free from manufacturing defects and corrosion for 5 years from the time of delivery.
8.2 This warranty does not cover:

Impact damage
-
Damaged caused by horses during turnout
-
Misuse or improper installation
-
Damage caused by extreme weather or flooding
-
Normal wear and tear
-
Use of unsuitable cleaning products

8.3 Warranty claims must be submitted in writing with supporting photographs.
​
8.4 The Warranty is non-transferable to another party.
​
This warranty is in addition to and does not affect your statutory rights under UK law.
​
9. Safety Disclaimer
9.1 Arena mirrors must be securely mounted onto a strong, sturdy, straight structure and be well supported in accordance with any installation guidance provided.
9.2 Arena mirrors are safety backed to BS EN 12600 2B2 frontal impact standards and incorporate an aluminium backing panel bonded to the back of the mirror and into the framework for enhanced safety. However, mirrors are not indestructible and may break if subjected to impact.
9.3 Regular inspection and maintenance are the responsibility of the Customer. Any damaged mirrors should be taken down and removed immediately from the arena.
9.4 The Company accepts no liability for injury, loss or damage arising from:

Improper installation

Inadequate structural support
-
Impact by horses, vehicles, machinery, or equipment

Misuse or neglect
The Customer is responsible for ensuring the Goods are suitable for their intended environment.

10. Retention of Title
10.1 Ownership of the Goods shall not pass to the Customer until the Company has received payment in full (in cleared funds) for:

The Goods supplied; and
-
Any other sums due from the Customer to the Company.
​
10.2 The Company may recover payment for the Goods even if ownership has not passed.
​
10.3 If payment is overdue or the Customer becomes insolvent, the Company may enter premises where the Goods are stored and repossess them.
​
10.4 Risk in the Goods passes to the Customer upon delivery.
​
11. Limitation of Liability
11.1 The Company’s liability shall be limited to the value of the Goods supplied.
11.2 The Company shall not be liable for indirect or consequential losses, including loss of business, income or profits.
​
12. Force Majeure
The Company shall not be liable for any failure or delay in performance due to circumstances beyond its reasonable control.
​
13. Governing Law
These Terms & Conditions are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the English courts.
